Sebi appoints observer for e-voting on winding up of Franklin Templeton’s six schemes

NEW DELHI: Sebi on Saturday said it appointed an observer and a technical assistant team, complying with the order of the Supreme Court of India, to oversee the e-voting of unit holders of six shuttered schemes of Franklin Templeton Mutual Fund.

Sebi in a release said it has appointed Taruvai Subayya Krishnamurthy, the former Chief Election Commissioner of India as the ‘Observer’ on December 18, 2020. The contact details of the Observer are krishnamurthy.ts@gmail.com and mobile number. +91 94449 99555.

The voting is scheduled between December 26 to December 29.

The release by Sebi comes after reports said Chennai Financial Markets and Accountability (CFMA) filed an application in the Supreme Court alleging that despite the apex court’s December 9 order, no apparent steps were taken by Sebi to appoint an observer for overseeing the e-voting process.

The market regulator clarified that the result of the voting will not be made public immediately. The Supreme Court has directed that the result of the e-voting would not be announced and would be produced before the court in a sealed cover along with the report of the Observer appointed by the Sebi.

Sebi has also constituted a technical assistance team comprising BN Sahoo, Chief General Manager, Sebi; Nayana Ovalekar, Chief Operating Officer of CDSL; K Sriram, Practising Company Secretary and Scrutiniser; M Krishna and Ch E Sai Prasad, Assistant Directors of Central Forensic Science Laboratory, Hyderabad.

The apex court is hearing the pleas, including the one filed by Franklin Templeton, against the Karnataka High Court order which stopped the fund house from winding up its debt fund schemes without prior consent of the investors.
